Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and TheCarShowsApp ("we," "us," or "our") governing your use of the TheCarShowsApp mobile application, website, and related services (collectively, the "Service").
By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance. We will notify users of material changes via the app or email.
Eligibility
You must be at least 13 years old to use TheCarShowsApp. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
The Service is intended primarily for use in the United States, though it is accessible worldwide. You are responsible for compliance with local laws in your jurisdiction.
Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@thecarshowsapp.com if you suspect unauthorized access.
- Provide accurate information when creating your account
- Do not share your login credentials with others
- Do not create multiple accounts to evade a ban or restriction
- Do not impersonate another person or organization
We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.
User Content
You retain ownership of your content. You represent that:
- You own or have the right to share all content you submit
- Your content does not infringe any third party's copyright, trademark, or other rights
- You have permission to share any personally identifiable information about others that appears in your content
- Your content complies with these Terms and all applicable laws
When you delete your account, your profile and photos are removed. Event listings you submitted remain on the platform as community data, as they represent factual information about public events.
Prohibited Conduct
You agree not to use the Service to:
- Post false, misleading, or fraudulent event information
- Harass, threaten, or intimidate other users
- Upload content that is obscene, hateful, discriminatory, or otherwise objectionable
- Spam other users or submit duplicate event listings
- Scrape, crawl, or systematically extract data from the Service
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its servers
- Upload malicious code, viruses, or any software designed to harm
- Advertise or solicit without authorization through our advertising program
Event Listings
TheCarShowsApp is a community-driven platform. Event listings are submitted by users and are not independently verified by us unless claimed by an organizer.
We do not guarantee the accuracy, completeness, or timeliness of any event listing. Always verify event details directly with organizers before attending.
By submitting an event, you represent that to the best of your knowledge the information is accurate. Intentionally submitting false event information may result in account suspension.
We reserve the right to remove, edit, or decline any event listing at our sole discretion.
Advertising and Paid Features
We offer paid advertising options including Event Boosts, Banner Ads, and Title Sponsorships. By purchasing any paid feature:
- You agree to our advertiser guidelines and content standards
- You represent that your business and advertising content comply with all applicable laws
- All purchases are subject to our refund policy — boosts that have run any portion of their period are non-refundable
- We reserve the right to reject or remove advertising that violates our standards
- Auto-renewing subscriptions will be billed at the agreed rate until cancelled
Payment processing is handled by Stripe. By making a purchase, you also agree to Stripe's Terms of Service.
Intellectual Property
TheCarShowsApp, its logo, design, code, and all original content are the intellectual property of TheCarShowsApp and are protected by copyright, trademark, and other applicable laws.
You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our express written permission.
"TheCarShowsApp" is a trademark. Unauthorized use of our name, logo, or branding is prohibited.
Third-Party Services and Links
The Service integrates with third-party services including Google Maps, Firebase, Stripe, and others. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.
The Service may contain links to external websites. We are not responsible for the content or practices of any linked sites.
Disclaimer of Warranties
Your use of the Service is at your own risk. We are not responsible for any harm resulting from your reliance on event listings or other user-submitted content.
Limitation of Liability
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless TheCarShowsApp and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Content you submit to the Service
- Your violation of any third party's rights
Termination
You may stop using the Service and delete your account at any time through the app's settings.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Service ceases immediately.
Sections of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification — will survive.
Governing Law and Disputes
These Terms are governed by the laws of the State of Mississippi, United States, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Mississippi under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.
You waive any right to participate in a class action lawsuit against TheCarShowsApp.
